Introduction & Acceptance
Welcome to Maskr.io. These Terms of Service ("Terms") govern your access to and use of the services provided by Maskr IO, LLC ("Maskr.io", "we", "us", or "our"), including our website at maskr.io, application programming interfaces (APIs), design plugins, and all related services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
Description of Service
Maskr.io provides AI-powered image processing services, including but not limited to: background removal, image upscaling, object removal, and other image manipulation features. The Service is available through our web application, design plugins (such as our Figma plugin), and REST API. Access to the Service is provided on a credit-based system. Credits are required to process images, with different operations consuming different amounts of credits based on the service, model, resolution, and output format used.
Account Registration
To use the Service, you must create an account using Google or Apple sign-in. You agree to: provide accurate information during registration; maintain the security of your account credentials and API keys; immediately notify us of any unauthorized access to your account; and accept responsibility for all activities that occur under your account. You must be at least 16 years old to create an account and use the Service. By creating an account, you represent that you are at least 16 years of age. We reserve the right to suspend or terminate accounts that violate these Terms.
Acceptable Use Policy
You agree not to use the Service to: upload, process, or distribute illegal content; process images that infringe on intellectual property rights of others; process images containing child sexual abuse material (CSAM) or content that exploits minors; distribute malware or engage in phishing; attempt to circumvent usage limits, security measures, or access controls; reverse engineer, decompile, or attempt to extract the source code of our AI models; use automated systems to abuse the Service beyond reasonable API usage; resell, redistribute, or white-label the Service without our written permission; or process images for any purpose that violates applicable laws or regulations. Violation of this policy may result in immediate termination of your account without refund.
Intellectual Property
The Service, including all software, AI models, algorithms, designs, trademarks, and documentation, is owned by Maskr IO, LLC and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works of any part of the Service without our written permission. "Maskr.io" and our logo are trademarks of Maskr IO, LLC. You may not use our trademarks without prior written consent. If you use our API commercially, you must include attribution to Maskr.io in your documentation, website footer, or about page (e.g., "Powered by Maskr.io" or "Image processing by Maskr.io").
User Content
You retain all ownership rights to images you upload to the Service ("User Content"). By uploading images, you grant us a limited, non-exclusive license to process the images solely for the purpose of providing the Service to you. We claim no ownership over your User Content or the processed results. You are solely responsible for ensuring you have the necessary rights to upload and process any images. You represent and warrant that your User Content does not infringe on any third party's intellectual property rights, privacy rights, or other legal rights. We do not review, monitor, or endorse User Content. We are not responsible for any User Content uploaded by you or other users.
Payment and Billing
The Service operates on a credit-based system with two types of credits: Subscription Credits are allocated monthly with your subscription plan, reset at the beginning of each billing cycle, do not roll over to the next month, and are used first when processing images. Wallet Credits are purchased separately, never expire while your account is active, are forfeited upon account deletion, and are used after subscription credits are depleted. All payments are processed by Stripe. By making a purchase, you agree to Stripe's terms of service. All purchases are final and non-refundable. You may cancel your subscription at any time; you will retain access to subscription features and any remaining subscription credits until the end of your current billing period. We reserve the right to change pricing with 30 days notice. Price changes will not affect your current billing period. If you file a chargeback or payment dispute with your bank or payment provider, we reserve the right to suspend your account immediately pending investigation. If the chargeback is determined to be fraudulent or in violation of these Terms, we may permanently terminate your account and pursue recovery of the disputed amount plus any fees incurred. Abuse of the chargeback process may result in reporting to fraud prevention services.
Service Availability
We strive to maintain high availability but provide the Service "as is" without guarantees of uptime or availability. We may: perform scheduled maintenance with reasonable advance notice when possible; experience unscheduled downtime due to technical issues; modify, suspend, or discontinue any part of the Service at any time; and change credit costs for services with 30 days notice. We will make reasonable efforts to notify you of significant changes. We are not liable for any losses resulting from service interruptions or modifications.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. IN NO EVENT SHALL MASKR IO, LLC, ITS DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.
Indemnification
You agree to indemnify, defend, and hold harmless Maskr IO, LLC and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from: your use of the Service; your User Content; your violation of these Terms; your violation of any third party's rights, including intellectual property rights; or any claims that your User Content caused damage to a third party. We reserve the right to assume exclusive defense of any matter subject to indemnification by you, at your expense.
Copyright and DMCA
Maskr.io is a transient image processing service. We do not store, host, or distribute user-uploaded content beyond the brief processing window (images are deleted within minutes). As such, we function as a service provider under the Digital Millennium Copyright Act (DMCA). Users are solely responsible for ensuring they have the rights to process any images they upload. If you believe your copyrighted work has been processed without authorization, note that: we do not retain copies of processed images; any allegedly infringing content was uploaded by a user, not created or distributed by us; and claims should be directed at the individual who uploaded the content. For copyright inquiries, contact [email protected]. We will respond to valid DMCA notices but may have no content to remove due to our automatic deletion policy.
Termination
You may delete your account at any time through your account settings. Upon deletion: your account and all associated data will be immediately and permanently deleted; any remaining wallet credits will be forfeited; if you have an active subscription, it will be cancelled immediately without refund. We may suspend or terminate your account immediately, without prior notice, if you: violate these Terms; engage in fraudulent or illegal activity; abuse the Service or other users; or fail to pay for the Service. Upon termination, all licenses granted to you under these Terms will immediately cease. Provisions of these Terms that by their nature should survive termination will survive, including intellectual property rights, indemnification, limitation of liability, and dispute resolution.
Dispute Resolution & Arbitration
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS. Any dispute, claim, or controversy arising from or relating to these Terms or the Service shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) in accordance with its Commercial Arbitration Rules. The arbitration shall be conducted in the State of Delaware, United States. The arbitrator's decision shall be final and binding. YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. If for any reason a claim proceeds in court rather than arbitration, you waive any right to a jury trial. Notwithstanding the above, either party may seek injunctive or other equitable relief in any court of competent jurisdiction. For disputes involving less than $10,000, you may choose to resolve the dispute through small claims court instead of arbitration.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any legal action or proceeding not subject to arbitration shall be brought exclusively in the federal or state courts located in Delaware. You consent to the personal jurisdiction of such courts.
Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. For significant changes, we may also notify you via email. Changes become effective immediately upon posting unless otherwise specified. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms. If you do not agree to the changes, you must stop using the Service and delete your account.
